RE: PROPOSED GREEN VIEW ESTATE DEVELOPMENT, REMAINDER OF FARM DROOGFONTEIN 245, DANA BAY: AVAILABILITY OF THE DRAFT SCOPING REPORT

Cape EAPrac has been appointed by the Applicant, Bart's Foundation Developments, as the independent Environmental Assessment Practitioner (EAP) responsible for ensuring compliance with the regulations contained in the National Environmental Management Act (NEMA), Act No. 107 of 1998 (as amended) and the National Environmental Management: Waste Act, Act No. 59 of 2008, for the proposed "Green View Estate" development on Remainder of Farm Droogfontein 245, Dana Bay. Cape EAPrac replaced Envirocor Management Services as the EAP for this process.

The Applicant proposes to develop a mixture of housing types at varying densities, including single residential, group housing (retirement units), general residential units (e.g. apartments). The residential components of the development will provide for a wide residential market and income segments, including the permanent, retired and holiday / second home market. Approximately fifty percentage of the development site will be dedicated to retirement market and or possible sectional title units. In total, the estate development will provide for approximately 2612 residential units across the property of total size 269ha. Provision is also made for internal open spaces and two nature reserves. The development proposal includes all required internal and external civil (water and sewer) and electrical infrastructure. The expansion of the Mossel Bay Municipal Pinnacle Point Waste Water Treatment Works is also being applied for as part of the development proposal, in terms of the National Environmental Management: Waste Act (NEM:WA Act 59 of 2008).

The proposed Green View Estate development triggers a number of listed activities, including:

 NEMA 107 of 1998 (as amended): GN R.544: 9, 10, 11, 16 & 18; GN R.545: 15; GN R.546: 12, 13 & 16;

 NEM:WA 69 of 2008: Category A Wastes: 19; Category B Wastes: 7 & 11

A Full Scoping & Environmental Impact Assessment process is being undertaken to cover the assessment of all the different activities and components of the development proposal.

This environmental process is based on an application lodged by Envirocor Management Services, lodged during 2006, with associated reports and public participation. The Final Scoping Report submitted by Envirocor to the Department of Environmental Affairs & Development Planning, was rejected during 2008. Cape EAPrac submitted a new application in terms of the newly promulgated 2010 Environmental Regulations, hence the new environmental process and new reports. In taking the information from the 2006-2008 process forward, Cape EAPrac has identified you as key stakeholder for this development. However: this does not automatically register you as an I&AP for this process,

This office furthermore notifies you of the Draft Scoping Report (DSR)'s availability for stakeholder review and comment. The DSR will be available for a commenting period of 40-days, extending from Friday, 30 September 2011 until Wednesday, 9 November 2011, at the following venues:

Ø Mossel Bay Municipality: Planning Department, Montague Place Building, 4th Floor, Montague Street, Mossel Bay

Any comments on the above report, must be submitted to Cape EAPrac in writing, on or before Wednesday, 9 November 2011, at the following contact details:

Between the 2008 and the current EIA process, a number of baseline specialist studies and investigations have been undertaken to consider the development proposal and receiving environment. A number of preliminary concerns have been identified. The available baseline specialist studies, including a Civil Services Report, Electrical Engineering Report, Geotechnical Study, Traffic Assessment, Freshwater Baseline Assessment, Visual Inventory Study, and Preliminary Fire Management Framework, are reported on in the DSR.

Upon closing of the 40-day comment period, all comments received will be considered, addressed and responded to, as well as included in the Final Scoping Report (FSR). The FSR will be made available for a further 21-day commenting period, following which it will be submitted to the DEA&DP for review and evaluation, prior to continuing with the Impact Assessment phase of the EIA process. The impact phase will allow all specialists the opportunity to undertake full impact assessments for their respective specialist fields. The Plan of Study for EIA included as part of the DSR, provides detailed information regarding the steps to be undertaken as part of the final phase of the EIA process.

Potential I&APs are requested to confirm their registration in writing to Cape EAPrac. Only registered I&APs will be kept informed throughout the remainder of the EIA process.
